Deputy District Attorney Andrew Bonavia said that per an agreement with Xavier D. Eaglin’s attorney’s, Kevin Jones, he’d recommend that bail be reduced in half from $50,000 cash bail or $100,000 bond to $25,000 cash bail or $50,000 bond.

Eaglin, who appeared in court shackled and in an orange jumpsuit, did not speak at the hearing. But Jones said he’s received evidence from Bonavia prior to the hearing — a video recording that included statements from Eaglin.

Eaglin, 19, is charged with felonies for first-degree rape and three counts of first-degree criminal sexual act. He is also charged with misdemeanor criminal obstruction of breathing or blood circulation.

Court records stated that police obtained a recorded video interview with Eaglin in which he confesses to the forced sex crimes. Also listed as evidence are a taped phone call between Eaglin and another person, as well as a sworn statement where he allegedly confesses to forced sex crimes.

Jones and Bonavia did not say in court what kind of statements from Eaglin were on the video.

Judge Richard Wallace allowed the felony preliminary hearing to be waived, per the agreement between lawyers, and approved the suggested bail reduction.

The case has now been divested to the Tompkins County Court and is pending Grand Jury action.

A spokeswoman at Cornell said Eaglin is currently banned from being on campus.

According to court records, the rape happened at a dorm around midnight on Feb. 15 at Balch Hall. The victim said to police that she repeatedly told Eaglin that she did not consent to sex and asked him to stop. She said she feared he would become physically aggressive if she resisted.

Eaglin is accused of holding his hand over the woman’s mouth and choking her with his other hand while he was raping her.

Police said an investigation into the accusations against Eaglin are ongoing and further charges are pending.
